Civil litigation covers a broad range of disputes between individuals or businesses. At Mtshali & Sishi Inc., we handle debt collection, debt review and administration orders, eviction and rental recovery, property disputes, motor vehicle collision and insurance claims, and unlawful arrest claims. We guide clients through every stage of the court process to protect their rights and interests.
To begin divorce proceedings in South Africa, one spouse (the plaintiff) must issue a summons in the High Court or Regional Court. The legal ground is irretrievable breakdown of the marriage. Our attorneys assist with both contested and uncontested divorces, as well as all related matters including maintenance, parental rights and responsibilities, custody, and the division of assets.
When a person dies intestate (without a valid will), their estate is distributed according to the Intestate Succession Act. Assets pass to surviving spouses and children in defined proportions, which may not reflect the deceased's wishes. We strongly recommend a professionally drafted will. Our firm assists with will drafting, winding up deceased estates, and the full administration of trusts.
Yes. If you were injured in a road accident caused by the negligence of another driver, you may be entitled to claim compensation from the Road Accident Fund (RAF). Claims can cover general damages, loss of earnings, and future medical costs. We also handle medical negligence and train accident claims. Important: these claims are subject to prescription periods, so prompt action is essential.
A Memorandum of Incorporation is the founding document that governs the internal affairs and structure of a company registered under the Companies Act of South Africa. It defines the rights, duties, and responsibilities of shareholders, directors, and officers. Our corporate and commercial team assists with company formation, MOI drafting, partnership agreements, and all related commercial contracts.
If you believe you have been unfairly dismissed, you must refer your dispute to the CCMA (Commission for Conciliation, Mediation and Arbitration) within 30 days of the dismissal date. Our labour law attorneys represent clients at the CCMA and in unfair labour practice disputes. We also advise on your rights, assist with misconduct investigations, and review employment contracts to protect your interests.
You can apply for a Protection Order at your nearest Magistrate's Court under the Domestic Violence Act — this is a civil remedy available even without involving the police first.
